Terms of service
Effective date: July 11, 2026
This page contains two agreements. The Terms of Sale govern products you order from Roosebeck.com. The Terms of Use govern your use of the site itself. Both apply. Roosebeck Fine Instruments is a brand of Mid-East Manufacturing, Inc., doing business as EnSoul Music Designs, Inc. ("Roosebeck," "we," "us," or "our").
Part One: Terms of Sale
This Terms of Sale Agreement (the "Agreement") is a binding legal contract between you and Roosebeck, the owner and operator of Roosebeck.com (the "Site"). By ordering any product through the Site, you accept this Agreement as it may be updated from time to time. Changes take effect when posted.
This Agreement supplements our Terms of Use, below, and our privacy policy. Please read all three.
Orders and sales tax
You may place orders on the Site at any time, subject to occasional planned or unplanned downtime.
Roosebeck is currently registered to collect sales tax in Florida only. Florida customers see applicable state and local sales tax added at checkout. Customers in other states do not see sales tax added to their order. You may owe use tax to your home state on out-of-state purchases. That obligation is between you and your state.
As Roosebeck grows and crosses sales thresholds in additional states, we will register in those states and begin collecting tax there. We do not collect tax in states where we are not registered.
Orders placed through Amazon or other marketplaces are subject to those platforms' tax collection policies, not this one.
Product descriptions
We describe every instrument as accurately as we can, including specifications, materials, dimensions, and finish details. We do not warrant that descriptions or other content on the Site are perfectly accurate, complete, current, or error-free. If you have a question about a specific instrument before ordering, email info@roosebeck.com and we will answer it.
Display and color
The colors and finish details you see on screen depend on the display and color settings of your monitor or device. Minor variation between what you see online and the actual instrument is normal. Each instrument is handmade, so small natural variations in wood grain, finish, and inlay are part of the character of the piece, not defects.
Returns and exchanges
Our return and refund policy is part of this Agreement. Please review it before placing an order.
Pricing
All prices on the Site are in U.S. dollars. Orders ship free within the continental United States. Orders to Alaska, Hawaii, Puerto Rico, and U.S. territories, are charged calculated shipping at checkout. See our shipping policy for details.
If a price posted on the Site is incorrect because of a typographical, technical, or supplier error, we reserve the right to cancel your order and refund you the full amount you paid, even if your order has been confirmed and your card charged. This applies regardless of how the error occurred.
Payment
We accept major credit and debit cards through Shopify Payments, along with Apple Pay, Google Pay, Shop Pay, and other methods shown at checkout. We do not accept checks, drafts, or money orders for orders placed through the Site.
If a payment is disputed and a chargeback is initiated, you agree to bear all costs associated with that dispute, including any fees charged to us by our payment processor.
Order confirmation and status
After you place an order, we send a confirmation email within one business day with your order number. When your order ships, we send a second email with carrier tracking information.
You can log into your account on Roosebeck.com to view order history and tracking. By placing an order, you consent to receive transactional emails from us about that order.
Shipping and risk of loss
Shipping terms are set out in full in our shipping policy. Title to the goods and risk of loss pass to you when we deliver the package to the carrier. If your shipment arrives damaged, follow the damage claim process described in our return and refund policy.
Security
Please review our privacy policy for information on how we handle payment data. In the event of unauthorized use of your credit card, notify your bank or card issuer directly.
Disclaimer of warranties
YOU WAIVE ALL OTHER REMEDIES, WARRANTIES, GUARANTEES, OR LIABILITIES, EXPRESS OR IMPLIED, ARISING BY LAW OR OTHERWISE, EXCEPT AS EXPLICITLY STATED IN THIS AGREEMENT OR REQUIRED BY APPLICABLE LAW. BY USING ROOSEBECK PRODUCTS, YOU ACKNOWLEDGE THAT YOUR USE IS AT YOUR OWN RISK AND THAT YOU ASSUME FULL RESPONSIBILITY FOR ANY COSTS ASSOCIATED WITH SERVICING OR REPAIRING ANY EQUIPMENT USED WITH ROOSEBECK PRODUCTS.
ROOSEBECK EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, QUALITY, PERFORMANCE, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
SOME STATES DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, SO THESE LIMITATIONS MAY NOT APPLY TO YOU. THE WARRANTIES IN THIS AGREEMENT GIVE YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE.
IF AN ITEM IS PURCHASED FOR CONSUMER USE, ANY IMPLIED WARRANTY EXPIRES WITH ANY EXPRESS WARRANTY ON THE PRODUCT.
Limitation of liability
ROOSEBECK HAS PRICED ITS PRODUCTS WITH THE UNDERSTANDING, AND YOU ACKNOWLEDGE, THAT ROOSEBECK WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, STATUTORY, PUNITIVE, EXEMPLARY, OR INDIRECT DAMAGES OF ANY KIND, ARISING FROM ANY COMMERCIAL, BUSINESS, ENVIRONMENTAL, TORT, WARRANTY, CONTRACT, STRICT LIABILITY, OR OTHER CAUSES, DIRECTLY OR INDIRECTLY CONNECTED WITH ANY ROOSEBECK PRODUCT OR ITS USE. THE ONE EXCEPTION IS CONSEQUENTIAL DAMAGES FOR PERSONAL INJURY ARISING FROM PRODUCTS PURCHASED FOR CONSUMER USE.
Follow all instructions and heed all warnings accompanying any product. Some items include small parts and may not be suitable for young children. Keep such items out of reach of children.
YOU AGREE NOT TO JOIN ANY LAWSUIT WITH ANOTHER PERSON OR SERVE AS A CLASS REPRESENTATIVE IN A CLASS ACTION AGAINST ROOSEBECK ARISING OUT OF YOUR PURCHASE OR USE OF PRODUCTS ORDERED THROUGH THE SITE.
Indemnification
YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD ROOSEBECK COMPLETELY HARMLESS FROM AND AGAINST ANY CLAIMS, DAMAGES, COSTS, AND EXPENSES, INCLUDING ATTORNEYS' FEES, ARISING FROM OR RELATED TO YOUR USE OF ANY ITEMS PURCHASED THROUGH THE SITE.
Governing law and venue
This Agreement, the entire relationship between you and Roosebeck, and any litigation or other legal proceeding between you and Roosebeck, whether grounded in tort, contract, statute, or equity, is governed by the laws of the State of Florida, without regard to its conflict of laws principles.
Any dispute arising from or related to this Agreement is subject to the arbitration and venue provisions in the Terms of Use below.
Part Two: Terms of Use
We provide services to you subject to the notices, terms, and conditions in this agreement. When you use any feature of the Site, such as customer reviews or account services, you are also subject to the rules and policies that apply to that feature, which are incorporated here by reference. We reserve the right to update this Site and these terms at any time.
Accessing, browsing, or otherwise using the Site means you agree to all the terms and conditions in this agreement. Please read it carefully before proceeding.
Use of the site
You represent and warrant that you are at least 18 years old, or that you are visiting the Site under the supervision of a parent or guardian.
Subject to these terms, we grant you a limited, revocable, non-transferable, non-exclusive license to access and use the Site through your internet browser for the purpose of shopping for personal items sold on the Site. The license does not extend to commercial use or use on behalf of any third party unless we agree in writing in advance. Any breach of this agreement immediately revokes this license without notice.
You may not reproduce, distribute, display, sell, lease, transmit, create derivative works from, translate, modify, reverse-engineer, disassemble, decompile, or otherwise exploit this Site or any portion of it, except as expressly permitted by us in writing. You may not use any information on the Site for the benefit of another business unless we permit it in advance.
We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion, including when we believe customer conduct violates the law or harms our interests.
You may not upload, distribute, or publish through the Site any content that:
- Violates or infringes the copyrights, patents, trademarks, service marks, trade secrets, or other proprietary rights of any person.
- Is libelous, threatening, defamatory, obscene, indecent, pornographic, or could give rise to civil or criminal liability under U.S. or international law.
- Contains bugs, viruses, worms, trap doors, Trojan horses, or other harmful code.
Content on this Site is for informational purposes. Anything you read here about playing technique, instrument care, tuning, or related topics is general guidance, not professional advice. Opinions submitted by users reflect those users, not Roosebeck.
If we assign you a password and account ID, you are responsible for all activity under that account, whether or not you personally authorized it, including all financial obligations. You are responsible for keeping your password secure and confidential, and you must notify us immediately of any unauthorized use or security breach at info@roosebeck.com.
Reviews and comments
Anything you submit to the Site, including ideas, questions, reviews, comments, and suggestions ("Submissions"), is treated as non-confidential and non-proprietary. We have a royalty-free, worldwide, perpetual, irrevocable, transferable right to use, copy, distribute, display, publish, perform, sell, lease, transmit, adapt, and create derivative works from any Submission, by any means and in any form. All Submissions become our property and will not be returned.
When you post a review or comment, you grant us the right to use the name you submit with it. You represent that you own the rights to anything you post, and that our use of it will not infringe any third party's rights.
You may not use a false email address, impersonate someone else, or mislead us or anyone else about the origin of a Submission. We may remove or edit any Submission at our discretion, but we are not obligated to.
Intellectual property
All text, graphics, button icons, images, audio clips, video, and software on the Site (the "Content") belongs to Roosebeck or its affiliates. The collection, arrangement, and assembly of all Content (the "Compilation") belongs to Roosebeck or its affiliates. All software used on the Site belongs to Roosebeck, its affiliates, or its software suppliers. The Content, the Compilation, and the software are protected by U.S. and international copyright law.
Roosebeck, Roosebeck Fine Instruments, EnSoul Music Designs, Mid-East Manufacturing, and related logos, slogans, and trade names are trademarks or registered trademarks of their respective owners. Using any of our trademarks without our written consent is prohibited. You may not use our trademarks in connection with any product or service in a way that is likely to cause confusion, disparage us, or in meta tags without our explicit consent.
Privacy
Please review our privacy policy, which also governs your visit to the Site.
Risk of loss
Risk of loss and title for items you purchase pass to you when we deliver the items to the carrier. Our shipping policy and our return and refund policy set out the standard terms of sale.
Termination
In addition to any other legal or equitable remedies, we may terminate this agreement or revoke any of your rights under it immediately and without prior notice. Upon termination, you must stop using the Site, and we may revoke any password or account ID issued to you. Termination does not affect rights and obligations that existed before termination, including payment obligations.
International access
The Site may be accessed from outside the United States. The Site may contain products or references to products that are not available outside the U.S., and any such reference does not imply availability outside the U.S. If you access the Site from outside the United States, you are responsible for complying with your local laws.
Disclaimer and limitation of liability
EXCEPT AS OTHERWISE PROVIDED IN OUR TERMS OF SALE ABOVE, THE SITE, THE PRODUCTS OFFERED FOR SALE ON IT, AND THE TRANSACTIONS CONDUCTED THROUGH IT ARE PROVIDED ON AN "AS IS" BASIS. WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SITE OR THE INFORMATION, CONTENT, MATERIALS, OR PRODUCTS INCLUDED ON IT.
TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, QUIET ENJOYMENT, DATA ACCURACY, AND SYSTEM INTEGRATION. THE SITE MAY INCLUDE INACCURACIES, MISTAKES, OR TYPOGRAPHICAL ERRORS. WE DO NOT WARRANT THAT THE CONTENT WILL BE UNINTERRUPTED OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM YOUR USE OF THE SITE, INCLUDING INDIRECT, INCIDENTAL, PUNITIVE, EXEMPLARY, SPECIAL, OR CONSEQUENTIAL DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ANY DAMAGES, REGARDLESS OF THE BASIS OF THE ACTION, WILL NOT EXCEED THE TOTAL AMOUNT YOU PAID US IN THE MONTH IMMEDIATELY BEFORE THE EVENT GIVING RISE TO LIABILITY.
Typographical errors
If a product is listed at an incorrect price or with incorrect information because of a typographical error or an error in pricing or product information received from a supplier, we reserve the right to refuse or cancel any order placed at the incorrect price, whether or not the order has been confirmed and your payment method charged. If we have already charged your payment method and the order is canceled, we refund the charge.
Links
The Site may contain links to other websites operated by third parties. We are not responsible for the operation or content of those sites.
Copyright complaints
We respect the intellectual property of others. If you believe your work has been copied in a way that constitutes copyright infringement, contact us at info@roosebeck.com with the details required by the Digital Millennium Copyright Act, including identification of the copyrighted work, the location of the allegedly infringing material on the Site, your contact information, and a statement made under penalty of perjury that you are authorized to act on behalf of the copyright owner.
Remedies
You agree that monetary damages alone would not adequately remedy a breach of this agreement, and that we are entitled to specific performance or injunctive relief, or both, in addition to any other damages we are legally entitled to recover, together with reasonable expenses of any dispute resolution, including attorneys' fees.
No remedy is exclusive of any other. Any waiver of a right by us does not imply waiver of any other right or any future similar right.
Applicable law
This Site is created and controlled by us in the State of Florida, USA. The laws of the State of Florida govern these terms, without regard to conflict-of-laws principles.
Disputes
Any dispute relating to your visit to the Site or to products you purchase through the Site shall be submitted to confidential arbitration in Melbourne, Florida. The only exception is that if you have violated or threatened to violate our intellectual property rights, we may seek injunctive or other appropriate relief in any state or federal court in Florida. You consent to jurisdiction in those courts and waive any objection based on lack of personal jurisdiction or forum non conveniens.
Arbitration is conducted under the Commercial Arbitration Rules of the American Arbitration Association then in effect. The arbitrator's award is final and binding and may be entered as a judgment in any court of competent jurisdiction.
To the fullest extent permitted by applicable law, no arbitration under this agreement may be joined with an arbitration involving any other party, whether through class action proceedings or otherwise. You agree to bring any claim individually, not as part of a class or representative action.
Any claim or cause of action arising out of or related to your use of the Site or this agreement must be filed within one year after the claim arose, regardless of any statute or law to the contrary, or it is permanently barred.
Severability
If any provision of these terms is deemed invalid, void, or unenforceable for any reason, that provision is severable and does not affect the validity or enforceability of the remaining provisions.
